These Terms and Conditions (“Terms”) govern your use of the SparkLink website and professional email services (including services associated with the domain sparklink.online). By using our website or services, you agree to these Terms. If you do not agree, do not use our services.
1. Service description
SparkLink provides domain-based professional email accounts. Users submit a request (including a questionnaire), and we may issue one or more email accounts after verifying identity and eligibility. The specific features, limits and pricing depend on your chosen plan and any separate agreement.
2. Account eligibility and verification
To request and use an account, you must:
- Provide accurate and complete information in the request form and any follow-up verification.
- Be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding agreement.
- Not be prohibited by law or our policies from using the service.
We reserve the right to verify your identity and eligibility before issuing or continuing an account. We may request documents or other information. Failure to provide required information or failure to meet our verification standards may result in refusal or termination of the account.
3. User responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Using the service in compliance with applicable laws and these Terms.
- Not using the service for illegal, abusive, fraudulent or harmful purposes (e.g. spam, phishing, malware distribution).
You must not attempt to gain unauthorised access to our systems or other users’ accounts, or to interfere with the proper operation of the service.
4. Billing and subscriptions
Fees for paid plans are as described on our Pricing page or in your order/contract. Unless otherwise agreed:
- Subscription fees are charged at the start of each billing period (e.g. monthly or annually).
- You must provide valid payment information. Failure to pay may result in suspension or termination of the service.
- Refunds are handled in accordance with our refund policy as stated at the time of purchase or in your agreement.
- Price changes will be communicated in advance where required by law or contract.
Enterprise or custom plans may be governed by a separate agreement that overrides these Terms where inconsistent.
5. Suspension and termination
We may suspend or terminate your access to the service if:
- You breach these Terms or our policies.
- We are required to do so by law or by a competent authority.
- Your use poses a security or legal risk.
- You fail to pay fees when due (after any applicable notice).
You may terminate your account or subscription as allowed in your plan or by contacting us. On termination, your right to use the service ceases. We may delete or retain data in accordance with our Privacy Policy and applicable law.
6. Intellectual property
We own or license the intellectual property in our website, branding and service (including SparkLink name and logos). You may not copy, modify or use our IP except as necessary to use the service in accordance with these Terms. You retain ownership of content you create or send using the service; you grant us the rights needed to operate and provide the service.
7. Liability and limitations
To the maximum extent permitted by law:
- The service is provided “as is”. We do not warrant that it will be uninterrupted, error-free or fit for a particular purpose beyond what is stated in our documentation or agreement.
- We are not liable for indirect, incidental, special, consequential or punitive damages (e.g. loss of profits, data or goodwill), whether in contract, tort or otherwise.
- Our total liability for any claims arising from or related to the service shall not exceed the fees you paid to us in the twelve (12) months preceding the claim (or such other cap as set in your contract).
Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum permitted by law.
8. Indemnity
You agree to indemnify and hold harmless SparkLink and its affiliates, officers and employees from any claims, losses and expenses (including reasonable legal fees) arising from your use of the service, your breach of these Terms, or your violation of any law or third-party rights.
9. General
These Terms constitute the entire agreement between you and SparkLink regarding the service, except where a separate written agreement applies. We may modify these Terms from time to time; we will post the updated version on this page and, where required, notify you. Continued use after changes constitutes acceptance. If any provision is held invalid, the remainder remains in effect. Our failure to enforce a right does not waive that right.
